Article 1 – Definitions

Withdrawal period:

The period within which the consumer may exercise their right of withdrawal.

Consumer:

A natural person who is not acting in the course of a trade or profession and who concludes a distance contract with the trader.

Ongoing contract:

A distance contract relating to a series of products or services, the obligations of which extend over a defined period of time.

Right of withdrawal:

The consumer's right to cancel the distance contract within the withdrawal period.

Trader:

DB-ECOM, the natural or legal person offering products to consumers via distance selling.

Distance contract:

A contract concluded between the trader and the consumer using only means of distance communication.

CESOP:

The Central Electronic System of Payment Information introduced by the European Union to monitor payment service providers.

Article 3 – Applicability

These General Terms and Conditions apply to every offer made by the trader and to every distance contract concluded with the consumer.


Prior to conclusion of the contract, these General Terms and Conditions will be made available to the consumer electronically or by other means.

Article 4 – The Offer

All offers are non-binding. The trader reserves the right to change offers at any time.


Every offer clearly states the total costs, including shipping costs, any customs duties, and additional charges imposed by the shipping provider or postal service.

Article 5 – The Contract

The contract is concluded as soon as the consumer accepts the offer and fulfils the stated conditions.


Receipt of acceptance is confirmed immediately by email.

Article 6 – Right of Withdrawal

The consumer may cancel the contract within 14 days of receiving the goods, without giving any reason.


The cost of return shipping is borne by the consumer when exercising the right of withdrawal.

Article 7 – Costs in Case of Withdrawal

The trader will refund all payments received within 14 days of receiving the withdrawal, provided the product has been returned in its original condition and original packaging.

Article 8 – Customs, Import Duties and VAT

All goods are shipped under Delivered Duty Unpaid (DDU) terms (Incoterms 2000). The consumer is solely responsible for all costs and obligations related to importation.


These obligations include, but are not limited to:

  • Payment of import duties, VAT or other applicable taxes
  • Customs clearance costs such as broker fees, inspection fees or handling charges
  • Compliance with local laws, product regulations and certification requirements


The trader does not act as importer. Legal ownership and responsibility transfer to the customer upon dispatch.


The trader provides the required trade documents (invoice, product description, declared value) but cannot guarantee that goods or documents comply with all local requirements.


The customer indemnifies the trader against all claims, fines or liabilities arising from non-compliance with import regulations.


👉  Customers are strongly advised to check local customs regulations before placing an order to avoid unexpected costs or delays.

Article 9 – CESOP Compliance

From 2024 onwards, payment service providers are required to register transaction data in the CESOP system.


DB-ECOM complies with these EU regulations, which may affect the monitoring and reporting of payments.

Article 10 – Conformity and Warranty

The trader guarantees that products conform to the agreement and applicable legal requirements.


Complaints regarding defects must be submitted in writing within 14 days of delivery.


Products must be returned in their original packaging and original condition.

Article 11 – Delivery

Orders are delivered within 2 to 3 weeks, unless otherwise agreed.


In the event of a delay, the consumer will be informed no later than 14 days after placing the order.


All orders are shipped under DDU terms, meaning the consumer is responsible for all import processes.


The trader ensures proper dispatch but is not liable for delays caused by customs.


Failure by the consumer to fulfil import obligations does not entitle them to cancellation or a refund.

Article 12 – Complaints

Complaints must be submitted in writing within 7 days of discovering the defect.


The trader will respond within 14 days. If a longer processing time is required, the consumer will be informed of the expected timeframe.

Article 13 – Disputes

These General Terms and Conditions are governed by Dutch law.


Disputes shall preferably be resolved by mutual agreement. If this is not possible, they will be submitted to the competent court in the Netherlands.
